The Wilson County Board of Zoning Appeals will meet Thursday, March 18, 2021 at 9:00 a.m.  in the County Commission Room at the Wilson County Courthouse, located at 228 East Main Street, Lebanon, Tennessee.

The following cases will be heard:

CASE 3864 (deferred from the February meeting which was held March 4, 2021)

REQUEST:  Mike Sloan is seeking to establish a legal lot of record without public road frontage in order to make an addition to the existing house.  The property became of record in September 1995.  The property located at 526 Vance Lane is Parcel 14.05 on Wilson County Tax Map 59.  The property consists of 6.96 acres and is zoned R-1 Residential. 

ORDINANCE REFERENCE:  ARTICLE 3 GENERAL PROVISIONS - SECTION 3.20 GENERAL EXCEPTIONS - 3.20.01 SUBSTANDARD LOT OF RECORD. Where the owner of a lot of record is defined in Article 2, Definitions does not own sufficient land to enable him to conform to the yard and other requirements of this Resolution, such lot may be used as a building site by the same or a subsequent owner provided that the yard space and other requirements shall conform to the requirements for the zone in which it is located. The lot must have been of official record as of July 10, 1974.  SECTION 3.40 NUMBER AND LOCATION OF BUILDINGS ON LOT - 3.40.03 No building shall be erected on a lot which does not continuously abut at least one public street for at least fifty (50) feet; the lot must be a minimum of fifty (50) feet in width to the building setback line.

 

CASE 3872 (deferred from the February meeting which was held March 4, 2021)

REQUEST:  Jeffery Mason is seeking to establish a legal lot of record without public road frontage.  The property located off of Central Pike is Parcel 30 on Wilson County Tax Map 123.  The property consists of twenty (20) acres and is zoned A-1 Agricultural. 

ORDINANCE REFERENCE:  ARTICLE 3 GENERAL PROVISIONS - SECTION 3.20 GENERAL EXCEPTIONS - 3.20.01 SUBSTANDARD LOT OF RECORD. CASE 3875

REQUEST:  Derrick Jobe is seeking to establish a barber shop in an accessory structure.  The property located at 7556 Hickory Ridge Road, Lot 4, Barlow and Turner Property is Parcel 3.05 on Wilson County Tax Map 79.  The property consists of 1.17 acres and is zoned R-1 Residential. 

ORINANCE REFERENCE:  ARTICLE 2 DEFINITIONS - SECTION 2.20 SPECIFIC TERMS - HOME OCCUPATION:  An incidental occupation customarily carried on in the residence, employing no more than one (1) person not residing on the premise and utilizing no more than twenty-five (25) percent of the usable floor area of all buildings; provided, (1) no article or service be sold or offered for sale on the premise other than that produced by such occupation, and (2) such occupation shall not require the alteration of buildings, new construction, or equipment and machinery not customarily used in residential areas.

CASE 3876

REQUEST: Richard and Alison Baden are seeking a variance of seven (7) feet from the west side yard setback requirement of fifteen (15) feet.  The variance will allow the proposed addition to be eight (8) feet from the west side property line.  Applicants also need a variance of approximately twenty-seven thousand, eight hundred and fifty (27,850) square feet from the lot size requirement of forty thousand (40,000) square feet, a variance of twenty-five (25) feet from the lot width requirement of one hundred and twenty-five (125) feet and a variance of nine (9) feet from the east side yard setback requirement of ten (10) feet for an existing accessory structure.  The accessory structure is one (1) foot from the east side property line.  The property located at 5417 Vanderbilt Road, Lot 5, Knobblehurst is Group “B”, Parcel 22 on Wilson County Tax Map 50 “A”.  The property consists of approximately twelve thousand, one hundred and fifty (12, 150) square feet and is zoned R-1 Residential.

ORDINANCE REFERENCE:  ARTICLE 5 ZONING DISTRICTS - SECTION 5.10 RURAL RESIDENTIAL (R-1) - 5.10.05 AREA REGULATIONS - B. SIDE YARD 1. For single and two-story structures located on interior lots, side yards shall be not less than fifteen (15) feet in width for a principal structure, and not less than ten (10) feet for an accessory structure. [resolution 15-2-12] - E. LOT WIDTH 3. Where dwellings are not served by a public sewer system there shall be a minimum lot width of one hundred twenty-five (125) feet at the front building line.  F. MINIMUM LOT AREA 4. Each lot not served by a public sewer system but served by a public water system shall have a minimum lot area of forty thousand (40,000) square feet.

 

CASE 3877

REQUEST:  Warren Stieffenhofer is seeking a variance from the size limit requirement for an accessory structure without a principal structure being located on the property.  The size limit requirement is three hundred (300) square feet due to the size of the property.  Applicant would like to build a fifteen hundred (1,500) square feet accessory structure.  Applicant is also needing a variance of approximately twenty-nine thousand, eight hundred and fifteen (29,815) square feet from the lot size requirement of forty thousand (40,000) square feet and a variance of twenty-five (25) square feet from the lot width requirement of one hundred and twenty-five (125) feet.  The property located at 755 Ramsey Road, Lot 12, Northside is Group “A”, Parcel 6 on Wilson County Tax Map 16 “E”.  The property consists of approximately ten thousand, one hundred and eighty-five (10,185) square feet and is zoned A-1 Agricultural.

ORDINANCE REFERENCE:  SECTION 3.90 ACCESSORY STRUCTURES IN

RESIDENTIAL AND/OR AGRICULTURAL ZONE DISTRICTS [resolution 07-7-5] - The

accessory structure being proposed does not exceed the following:  A-1 - 3% of total lot

area or 2,000 square feet, whichever is less.  E. LOT WIDTH 5. Where dwellings are not served by a public sewer system there shall be a minimum lot width of one hundred twenty-five (125) feet at the front building line. [revised 07-7-4] - F. MINIMUM LOT AREA 3. For each dwelling and buildings accessory thereto, not served by a public sewer system but served by a public water system, there shall be a minimum lot area of forty thousand (40,000) square feet. 

 

CASE 3878

REQUEST:  Gary Thorne is seeking a variance of ten (10) feet from the easement width requirement of thirty (30) feet.  The property became of record in July 1964.  Applicant is also seeking to waive the paving and sewer requirements.  The property located at 1852 Sparta Pike; Bill Finchum Property is Parcel 26 on Wilson County Tax Map 91.  The property consists of 80.51 acres and is zoned I-1 Industrial.

This section shall not apply to a lot of record (previously existing), with an easement of at least thirty (30) feet in width to a public street. SECTION 3.41            COMMERCIAL OR INDUSTRIAL USE OF PROPERTY - Within any commercial or industrial zone district the following will be required: Prior to any commercial or industrial use of property, a public sewer system as defined by this zoning ordinance must be in place for the provision of sewerage disposal.

[resolution 07-7-4] - SECTION 3.50 OFF-STREET PARKING REQUIREMENTS -

3.50.03 PARKING LOT LAYOUT, CONSTRUCTION AND MAINTENANCE - Whenever the required off-street parking requires the building of a parking lot, and wherever a parking lot is built, such parking lot shall be laid out, constructed, and maintained in accordance with the following regulations:  E. Paving - All areas devoted to off-street parking and access drives, as required under this section, shall be of a sealed surface construction of plant mix asphalt or concrete construction.  A 6” X 12” curbing shall be installed on all off-street parking areas.  This requirement shall not apply to farming, single family, two family uses, or places of worship not located on arterial thoroughfares, as designated by the Wilson County Major Thoroughfare Plan. CASE 3879

REQUEST:  Ken Nelson on behalf of Jaime Castleman is seeking a variance of sixteen (16) feet from the easement width requirement of thirty (30) feet.  The property became of record in August 1957 and the easement became of record in March 1987.  The property located at 3929 Cedar Forest Road is Parcel 12 on Wilson County Tax Map 135.  The property consists of one hundred and thirty (130) acres and is zoned A-1 Agricultural.

CASE 3880

REQUEST:  Taylor Rucker is seeking a variance of five (5) feet from the setback requirement  of eight (8) feet between structures.  The variance will allow the proposed garage to be three (3) feet from the existing house and meet the ten (10) feet side yard setback requirement.  The property located at 106 Tanglewood Drive, Lot 35, Hillhurst is Group “B”, Parcel 4 on Wilson County Tax Map 53 “O”.  The property consists of 1.30 acres and is zoned R-1 Residential. 

ORDINANCE REFERENCE:  ARTICLE 5 ZONING DISTRICTS - SECTION 5.10 RURAL RESIDENTIAL (R-1) - 5.10.05 AREA REGULATIONS - B. SIDE YARD - 4. The minimum spacing between accessory structures and any other structure on the same property shall be eight feet (8’-0”) wall to wall between walled structures. [revised 10/19/2020 resolution 20-10-20]

 

CASE 3881

REQUEST:  Reed Clark is seeking a variance of thirty-eight (38) feet from the south rear yard setback requirement of forty (40) feet for the existing house, a variance of twenty-six (26) feet from the southeast rear yard setback requirement of forty (40) feet and a variance of five (5) feet from the east side yard setback requirement of fifteen (15) feet.  The applicant also needs a variance of approximately twenty-four thousand, five hundred and ten (24,510) square feet from the lot size requirement of forty thousand (40,000) square feet.  The existing house is two (2) feet from the south rear property line.  The variances will allow the proposed addition to be fourteen (14) feet from the southeast rear property line and ten (10) feet from the east side property line.  The property located at 1124 Shadow Lane, Lot 18, Lake Forest Acres is Group “C”, Parcel 16 on Wilson County Tax Map 29 “J”.  The property consists of approximately fifteen thousand, four hundred and ninety (15,490) square feet and is zoned R-1 Residential. 

ORDINANCE REFERENCE:  ARTICLE 5 ZONING DISTRICTS - SECTION 5.10 RURAL RESIDENTIAL (R-1) - 5.10.05 AREA REGULATIONS - B. SIDE YARD 1. CASE 3882

REQUEST:  Kimley Horn is seeking a variance of three hundred and twenty (320) parking spaces from the requirement of five hundred and eighteen (518) parking spaces.  The variance will allow for one hundred and ninety-eight (198) parking spaces.  The property located on Aldi Boulevard, Lot 3, Couchville/840 Investors is Parcel 37.05 on Wilson County Tax Map 138.  The property consists of ten (10) acres and is zoned C-4 Commercial.

3.50 OFF-STREET PARKING REQUIREMENTS - 3.50.02 NUMBER OF PARKING SPACES REQUIRED   - Industrial establishment - One (1) per two (2) employees or the combined two (2) largest successive shifts or one (1) space per five hundred (500) square feet of usable floor area, whichever is greater, plus adequate space for customer and visitor vehicles as determined by the Planning Commission.
