RESOLUTION OF THE BOARD OF COUNTY COMMISSIONER OF WILSON COUNTY, TENNESSEE TO IMPLEMENT A FEE FOR LAND USE AMENDMENT APPLICATION

NOW, IT THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Wilson County, Tennessee that the fee for an amendment to the Wilson County Land Use Plan be imposed at the rate of $600.00

A Land Use Plan Amendment may not be presented to the Wilson County Planning Commission for one year if denied.

BE IT FURTHER RESOLVED that the fee for a Land Use Amendment take effect from and after the adoption of this Resolution, the welfare of the County requiring it.

Subdivision Regulation Amendment

RESOLUTION OF THE REGIONAL PLANNING COMMISSION OF WILSON COUNTY, TENNESSEE REQUIRING ADDITIONAL FEES FOR APPLICANT DEFERRAL REQUESTS BEYOND ONE DEFERRAL PERIOD.

 

            WHEREAS Wilson County Development Services Department currently is tasked with reviewing SUBDIVISION PROPOSAL and SITE PLAN requests in addition to other tasks such as Rezoning request reviews, Board of Zoning Appeals case reviews, Drainage plans review, permitting and enforcement, Regional plans creation and drafting of development regulations and.

WHEREAS, many of these items require Publication for public advertisement, as well as, scheduling of required meetings, and

WHEREAS, advertising, postage, man hour wages, and amount of staff resources expended are all increasing in relation to excessive requests for deferral that are not originated or at least supported by County staff.

            NOW, THEREFORE, BE IT RESOLVED by the Wilson County Regional Planning Commission of Wilson County, Tennessee that the following policy be adopted and incorporated into the Wilson County Subdivision Regulations at the following locations:

  1. UNDER ARTICLE 6 ENFORCEMENT AND PENALTIES FOR VIOLATIONS, SECTION B - PENALTIES, Add the following language:

“4. EXCESSIVE DEFERRALS

Beyond a single request for deferral (1 instance); Any deferral requests which is granted at the request of the applicant and not specifically requested at the behest of the County Staff, or Planning Commission, shall be required to pay an additional $150.00 to cover the advertising, postage and additional man hour costs associated with rescheduling this item to be heard by public meeting.”
